Cassiopeian Branch of WMO to Rokkenjima Courts

To Whom it May Concern

Today is was announced via RBC that your nations navy had sunk a ship as it " moves through the Peniche demonstrates a Rokkenjiman capability to strike a target regardless of where it is, or if it is mobile"

For a moving vessel to be struck that vessel must contain fuel, coolant, oils and various other chemicals including such elements as batteries. This is even before we examine the extent to which corrosion of other parts needed for movement are considered. As such it is impossible for such an action to not have environmental damage.

As the Declaration of Rights' for Cetaceans and Elephants states "Cetaceans and elephants have the right to the protection of their natural environment.". By the intentional sinking of such a vessel in such a manner we believe that the Rokkenjiman Navy, and therefore its commander in Chief have failed to do such. As a result we are bringing a case of their behalf for breaching the Declaration and damaging the rights laid out under Rokkenjiman law.

Signed

Mr. Telis Latsis
Co-Chair of Cassiopian branch of WMO.

Section I Article 3 of the Rokkenjiman Constitution declares the following:

The Empress is sacred and inviolable.

Many times during the history of the First Empire this Article, in combination with Article 4 (The Empress is the head of the Empire, combining in Herself the rights of sovereignty, and exercises them, according to the provisions of the present Constitution) ensures that the Crown maintains sovereign immunity from prosecution under civil or criminal proceedings.

As such, the Supreme Court of Judicature will not be hearing any cases against Her Imperial Majesty, the Empress Evanthe Rhodes.

It is my personal recommendation that you consult with Imperial High Command and the Ministry for Defense on this matter, as those avenues may yield a better result.

Respectfully;

Chief Justice Benjamin Stone

Beatrice Anselmo
Grand Chancellor of the Independent Order
Empress of the First Empire of Rokkenjima

To Chief Justice Stone

While we appreciate your swift respone to our request we are disappointed.

We shall of course have no choice but to stand by the decsion of the courts. We also believe however that the Decree for Rights of Nature[/ur] have been violated. Large deposits of iron in the environment have been known to harm and change the make up of protoplankton and as such mean that this vital part of the ecosystem will no longer be able to " regenerate its vital cycles" in its natural manner. Furthermore we also believe other actions under taken by the ROkkenjiman state could be interpreted as failing in the legally ascribed need for  "The First Empire will apply precaution and restriction measures in all the activities that can lead to the extinction of species, the destruction of the ecosystems or the permanent alteration of the natural cycles.".

It is also our belief that the Uppsala Convention makes clear that each soldier is responsible for their actions and therefore if  Admiral Sugimoto Kisho is facing action then every individual in the "Kill chain" should also as they had the responsibility to not act against the Convention and also national, in their case Rokkenjiman, law. The Uppsala Convention states "National Governments shall not employ weapons, projectiles and methods and materials of warfare designed to cause , or can be expected to cause widespread, long-term and severe damage to the natural environment." The Uppsala Convention makes it the responsibility of every soldier to follow this.
