La Constitution

Préambule

Le peuple Fleuroix proclame & affirme solennellement son attachement à la Convention des Droits de l’Être Humain de l’An I ainsi qu’aux principes de la Souveraineté Nationale de l’An I qui demeurent inviolables et code de conduite de la République.

   En vertu de ces principes, le peuple Fleuroix se réserve le Droit de Contestation de toute décision menée à l’encontre desdits textes ainsi qu’à l’encontre de son ultime Droit à l’Égalité, la Liberté, la Santé, la Sécurité, l’Éducation et au Bonheur, qui est la mission première de toutes institutions et structure de la République, que de protéger et d’agir en alignement avec. Ces sept Droits cités, sont référés en tant que Droits Fondamentaux, inculqués au sein de la République.

Article Premier

   La République Fleuroise est une nation, souveraine, indivisible, athéiste, démocratique et méritocratique, ceux-ci sont ses valeurs secondant celles pré-citées dans le Préambule. Elles sont la juste cause du peuple Fleuroix, ainsi que de son engagement pour les générations futures, et sont prétexte à l’engagement de la République et du peuple Fleuroix dans la défense, tout en les respectant, aussi bien des menaces de l’intérieur que de l’extérieur.

Article Second

   La structure de la République Fleuroise, et des institutions qui en découlent, est une architecture promouvant une démocratie directe et fiable respectant, affichant et promouvant ses valeurs. Elle assure les Droits Fondamentaux et transmet une stabilité pour les générations futures tout en faisant évoluer sa structure ainsi que ses institutions pour rester dans l’air du temps, au plus près des préoccupations ainsi que des affaires du peuple Fleuroix et des dilemmes & défis de la République.

   Les symboles de la République Fleuroise et du peuple Fleuroix sont les suivants :

Le drapeau national est le drapeau Sang-de-bleus-blancs.

Le drapeau d’honneur national est le Sang-de-bleus-blancs Arché.

L’armoirie nationale est l’Arché.

L’hymne national est Mourir pour Elle.

La devise nationale est La Liberté ou la Mort.

Article Quart

   Les considérations citées dans l’Article Premier sont du seul peuple Fleuroix, elles lui appartiennent sans aucune contestation possible, et lui appartient à travers ses Droits Fondamentaux de l'exercer, et ce travers à l’exercice de son engagement pour la structure et les institutions de la République. Ces Droits et considérations sont exercées à travers l’Action Publique, un référendum national ouvert à tous les citoyens de la République, en tant que seul organisme législatif de la République, mis en place hebdomadairement pour proposer de nouvelles résolutions & idées sous forme de texte à l’unité, qui sont soumisent au peuple Fleuroix qui se voit le devoir d’accepter ou de les refuser, avec aucune autre alternative disponible, permettant à la République de couvrir toute législation nécessaire non couverte dans le cas de cette Constitution ou considérée comme extraordinaire ou spéciée selon les dispositions de cette Constitution. Le peuple Fleuroix se réserve de demander une Action Publique sur toutes résolutions & idées en lien avec les valeurs de la République et ses Droits Fondamentaux sous réserve de la signature de un virgule cinq pourcents du peuple Fleuroix demandant cette dernière, incluant la révocation d’un Directeur. Les résolutions & idées de l’Action Publique sont valides à partir de la majorité de cinquante pourcent du total des votes.

   Pour chaque nouvelle résolution et/ou idée proposée lors de l’Action Publique, la République mettra à disposition du peuple Fleuroix les emplacements physiques nécessaires pour l’organisation de débats ainsi que des facilités pour communiquer.

Article Quint

   Les actifs et services de la République envers le peuple Fleuroix est divisé en six divisions, la Direction des Affaires Diplomatiques & Commerciales, la Direction des Affaires Éducatives & Scientifiques, la Direction des Affaires Militaires & Stratégiques, la Direction des Affaires Sanitaires & Préventives, la Direction des Affaires Structurelles & Énergétiques, divisions dites non-spéciales, ainsi que la Direction Spéciale des Affaires Internes & Financières, listant et établissant l’entièreté des actifs de la République, avec pour seul but de répondre aux Droits Fondamentaux du peuple Fleuroix.

Chaque Direction se verra nommé un Directeur élu au suffrage universel par le peuple Fleuroix pour un mandat de cinq années trois mois avant la fin dudit mandat, en canon sur les cinq divisions dites non-Spéciales, avec la nécessité d’obtenir la majorité à cinquante pourcent des votes exprimés. Tout Directeur validé par l’Action Publique hors de ses fonctions, se devra de démissionner dans le jour suivant. Des élections exceptionnelles seront organisées sous dix jours selon le processus définit dans ce-même article, offrant pour mandat la totalité du temps incombant prévu au Directeur-sortant.

Ce Directeur a pour mission de servir la République et le peuple Fleuroix en vertu de la présente Constitution, ainsi que de proposer toutes les six semaines une nouvelle résolution ou idée sous forme de texte à l’Action Publique avec pour considération les valeurs de la République et les Droits Fondamentaux. La Direction Spéciale des Affaires Internes et Financières est tournante et se verra changée sur une base annuelle de Directeur, avec pour occupant le Directeur le plus avancé dans son mandat, d’une des divisions dites non-Spéciale.

   La Direction des Affaires Diplomatiques & Commerciales a pour mission de gérer l’entièreté des relations diplomatiques, officielles & officieuses avec les nations & organismes internationaux, de définir la ligne de conduite de la République ainsi que de promouvoir à l’exportation le savoir-faire du peuple Fleuroix.

   La Direction des Affaires Éducatives & Scientifiques a pour mission d’éduquer et assurer à travers l’enseignement un futur pérenne pour le peuple Fleuroix, ainsi qu’à travers la recherche dans tous les domaines civils, l’accomplissement de la République.

   La Direction des Affaires Militaires & Stratégiques a pour mission l’accomplissement de la sécurité des besoins matériels & physiques du peuple Fleuroix et de ses intérêts, ainsi que la sûreté de l’intégrité territoriale et de la souveraineté nationale à travers une indépendance totale et une saine gestion des forces armées, l’Armée de l’Air et l’Armée de Terre.

   La Direction des Affaires Sanitaires & Préventives a pour mission la prévention & l’engagement pour une sûreté public en toute conditions sur le territoire et pour le peuple Fleuroix.

   La Direction des Affaires Structurelles & Énergétiques a pour mission d’assurer l’approvisionnement des besoins du peuple Fleuroix ainsi que de la République en tout temps pour sa vie & survie s’il en venait ainsi, ainsi que la sécurité & facilité de déplacement et communication à travers le territoire national.

   La Direction Spéciale des Affaires Internes & Financières a pour mission la définition & le maintien d’une stabilité financière & budgétaire sans faille, toujours profitable pour le futur du peuple Fleuroix sans mettre en danger de loin ou de près ce dernier, en garantissant l’application et le maintien de l’Ordre Républicain ainsi que des Lois de la République par ses citoyens ou étrangers venant sur le territoire national à travers la Gendarmerie.

   Les Directions peuvent inaugurer & investir dans des sociétés, devenants ainsi Sociétés d’États, au service du peuple Fleuroix et de la République. Ils leur appartient d’assurer la pérennité à travers une bonne et saine gestion de ces dernières. Toute cessation d’actifs dans une Société d’État se devra être validée par l’Action Publique.

   Les Directions s’approprient un mode de fonctionnement transparent en tout point, excepté les points estimés relevant de la sûreté de l’intégrité territoriale et de la souveraineté nationale pouvant mettre à mal le peuple Fleuroix et la République. Ces derniers seront déclassés cent ans après leur création, qu’ils soient d’actualité ou non.

   Les Directeurs forment à eux, Le Directoire, chargé de se réunir hebdomadairement pour se synchroniser, gérer et convenir des affaires opérationnelles de la République.

   Chaque Directeur a autorité pour définir l'exécutif dans ses missions respectives, et lui incombe toute la responsabilité dans ses missions et domaines, et ce dans le stricte cadre de la Constitution et de la Loi, en accordance totale avec les Droits Fondamentaux du peuple Fleuroix et des valeurs de la République.

   La résolution ou idée validée par l’Action Publique, le Directeur proposant se verra l’autorité et le devoir de faire le changement voté effectif dans un délai de dix jours. Si la résolution ou idée validée a été proposée par demande du peuple Fleuroix, cette autorité et devoir incombe au Directeur Spécial des Affaires Internes et Financières.
   
Article Sixte

   La Garde Républicaine a pour seul maître la Constitution et les obligations qu’elle entraîne. Elle a pour mission d’appliquer et de faire respecter la présente Constitution et ses obligations. Elle a également pour mission secondaire, de protéger les représentants de la République dans leurs fonctions officielles ainsi que les bâtiments de la République. Dans ses missions, elle ne pourra en aucun cas rompre sous quelconque raisons à la présente Constitution. En cas de différence d’interprétation stricte basée purement sur la Constitution, une provisoire sera fournie par La Constitutionnelle, et se devra de passer en Action Publique comme toute résolution & idée, la Garde Républicaine s’alignera sur cette dernière validée.

   La Garde Républicaine a le privilège d’avoir une transparence totale sur les comptes de la République, ainsi que des comptes et possessions privés sur le territoire national ou non des fonctionnaires, ces derniers devant s’appliquer en cas de demande de transparence de la part de la Garde Républicaine, un refus menant à une démission forcée.

Article Septime

   La Constitutionnelle a pour charge de gérer l’entièreté de la structure et des institutions judiciaires de la République. Elle est composée de neuf Haut-Juges composant la plus haute instance judiciaire de la République, le Conseil Constitutionnel. Ses responsables et représentants, donc les neuf Haut-Juges, sont issus d’une méritocratie stricte basée sur la transparence la plus complète, ainsi qu’une intégrité à toute épreuve envers le peuple Fleuroix et la République. L’Action Publique se réserve le Droit d’organiser de façon organique les Lois d’accession ou par nomination au statut de Haut-Juge.

   Elle se réserve le droit de mener à bien, en s’appuyant sur la Garde Républicaine en vertu de la présente Constitution pour mener de façon proactive ou demandée par la Direction Spéciale des Affaires Internes & Financières, des enquêtes. Le rapport de toute enquête se verra publiée en toute transparence sous un délai de cinq jours maximum suivant sa conclusion.

   À la suite d’une enquête, si un ou des titres d’accusations sont relevés, ils seront pris en considération par La Constitutionnelle et appuyés.

Article Octave

   La République se réserve le droit de guerroyer pour la sécurité des besoins matériels & physiques du peuple Fleuroix et de ses intérêts, ainsi que la sûreté de l’intégrité territoriale et de la souveraineté nationale et la défense des valeurs de la République et des Droits Fondamentaux du peuple Fleuroix.

Elle peut décider proactivement de guerroyer, à travers une Déclaration de Guerre envers une entité extérieure, qui nécessite l’unanimité des votes du Directoire, ou si elle est demandée par le peuple Fleuroix à travers une demande d’Action Publique, elle ne sera validée qu’à partir de soixante-quinze pourcent de la totalité des votes y étant favorables.

   La République se réserve également le droit de sanctionner toute action par une entité extérieure jugée contre ses intérêts ou ses valeurs, ou pouvant nuire aux Droits Fondamentaux du peuple Fleuroix.

Amendements

   Le peuple Fleuroix se réserve l’autorité d’amender la présente Constitution à travers l’Action Publique, où tout amendement présenté sera validé et effectif avec l’atteinte de cinquante-cinq pourcent en faveur du total des citoyens en âge de majorité. L’amendement sera opéré par La Constitutionnelle qui mettra en place dans les cinq jours suivant le vote validé, et à partir d’ici-là seront effectifs et sans délai considéré comme faisant partie intégrante de la Constitution.

La Garde Républicaine

First founded in 1792 as “La Garde du Peuple” (translation: “Guard of the People”) to protect the newly established Republican institutions against the outside, but also of the inside, fearing effectively a coup d’état being intended by strong parties into the République, leading to the training alongside oath from all its units to only agree the Constitution and the Laws as sole leader and directive.

Given its exceptional form, due to its creation in specific times, La Garde Républicaine is one of its kind, having no equivalent Mundus-wide. It have as sole duties the ones specified in the Constitution: the protection of the said Constitution, alongside physical protection of the Republic’s representatives, namely the Directeurs, Ambassadeurs and the Haut-Juges and buildings of the République.

L’Action Publique

Officially adopted as the system to decide major decisions instead of a parliament in 1967, L’Action Publique consist of a weekly referendum (10 days weeks) for allowing the Citoyens to vote on various matters, each time issued by a different Direction.

La Constitutionnelle

Originally founded in 1792 as “La Cour de Justice”, La Constitutionnelle’s powers and authorities have well evolved, from being a judiciary organism relying on politics, to becoming a fully independent and central organism in the life of the République, that ensures all the judiciary powers of the République while maintaining a strong meritocratic alongside neutral stance and function.

La Constitutionnelle have its own organism to enforce its decisions alongside laws, other than La Garde Républicaine which have similar duties, but concerning the leadership of the République alongside La Constitution directly. La Gendarmerie is relying entirely under La Constitutionnelle, and therefore is independent. Its behaviour and organisation is very similar to the one of the Forces Armées. It have as main purpose to defend and most importantly, enforce law throughout the République. Through laws, and judgements, La Constitutionnelle is indirectly giving orders to La Gendarmerie in all transparency.

La Gendarmerie

The heir to “La Maréchaussée” formed under the Monarchy back in 1578, La Gendarmerie is the law enforcement force, alongside guardians of the République, under the direction of La Constitutionnelle, ensuring its full independence and neutrality within politics.

Its effectives are of 78 125 active-Gendarmes, between the age of 25 and 75.

The Direction of Diplomatics and Commercials Affairs (in French : “La Direction des Affaires Diplomatiques & Commerciales”) have as mission, defined in La Constitution as : “a pour mission de gérer l’entièreté des relations diplomatiques, officielles & officieuses avec les nations & organismes internationaux, de définir la ligne de conduite de la République ainsi que de promouvoir à l’exportation le savoir-faire du peuple Fleuroix.”, managing the entirety of the diplomatic relations, officials and unofficials with nations and international organisms, defining the line of conduct of the Republiqué along promoting to export the savoir-faire of the Fleuroix people.

The République maintains diplomatic relations with 27 organisms, share 26 embassies with as policy to maintain such only with ratifiers of the Rochetaillée Convention on Diplomatic and Consular Relations for a total of 38 local offices (Embassies and Consulates). La Direction des Affaires Militaires et Stratégies (or in English, “Direction of Military and Strategic Affairs”) is the Direction in charge of all defense affairs and on every of its aspects. The Direction is also in charge of maintaining strategic capabilities, like for example the Programme Diamant which is a totally independent space program able to send satellites in low, middle and high orbits for Fleuroix strategic needs, and is well separated from any civil program and refute any possibility of privatisation, even through association. It is the smallest of the 5 Directions budget, with 5% of the budget or 2 037 476 700 821,26 SB (18 337 308 644,70 USD) for the An CCXXVIII budget.

The République Fleuroise military is organised as the following:

Force Aéronautique: composed of 5 Escadrons totalising 25 Escadrilles, with each being assigned to one of the 14 Corps and some in reserve, for a 31 250 personnel, along 31 250 more in reserve. With 58% of the military budget, the Force Aéronautique is by far the largest of the 4 Branches, with 1 181 736 486 476,7800 SB (10 635 639 013,93 USD) allocated for the sole An CCXXVIII. Force Navale: composed of 2 amphibious assault ships, 6 frigates, 2 submarines and 5 support vessels, it is the smallest of the 4 Branches, as much as in manpower than in financial terms. Given its limited scope alongside investment, it is considered as the least important of the Branches, as the Republic does not have seas ambitions and relies heavily on its terrestrial defenses and air force. With 3 125 active personnel, none reserve personnel, for 2% of the budget, or 40 749 534 015,9808 SB (366 746 172,89 USD) allocated for the sole An CCXXVIII.
